These Terms of Service (“Terms”) govern your access to and use of the Alyesis website (https://www.alyesis.com/), mobile applications (if any), booking systems, membership services, fitness, training, and recovery services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Services.
1. Definitions
For purposes of these Terms, “User,” “Member,” or “Client” refers to any individual who uses, books, or subscribes to Services offered by Alyesis. The terms “We,” “Us,” “Our,” and “Alyesis” refer to Alyesis and its agents, employees, and contractors. “Booking” or “Appointment” means the scheduling of a session, consultation, training, therapy, or other service. “Membership” or “Subscription” refers to a recurring plan or package that provides access to facilities, classes, or services. “Content” means all text, media, images, video, audio, or other materials provided through the Services. “Equipment” or “Facility” refers to physical resources, premises, machinery, and recovery tools used in the delivery of Services.
2. Scope and Eligibility
To use our Services, you must be at least the age of majority in the State of California or have verified parental or guardian consent. You agree to provide accurate, current, and complete information when registering, booking, or purchasing any Services. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account.
3. Service Use, Booking, and Membership
You may book sessions in advance through our website or booking system. All cancellations or rescheduling must occur at least [insert number of hours/days] prior to the scheduled start time. Failure to do so may result in a cancellation fee or the forfeiture of the session credit. Alyesis reserves the right to cancel, reschedule, or modify any session due to trainer availability, maintenance, or other reasonable operational reasons, and will provide notice when possible.If you enroll in a recurring membership or subscription plan, you authorize Alyesis to charge your designated payment method at each renewal interval. You may pause, upgrade, or cancel your membership according to the terms of your plan. Alyesis may adjust membership fees at any time with prior notice before new charges take effect.When using our facilities or equipment, you agree to follow all posted rules and staff instructions. You acknowledge that participation in exercise, training, or therapy involves inherent risks, including the risk of physical injury. You accept full responsibility for your participation and agree to promptly report any hazards or equipment issues to staff.
4. Health, Safety, and Medical Disclosures
You must inform Alyesis of any medical conditions, injuries, or physical limitations prior to engaging in any training or therapy services. The Services provided by Alyesis are not a substitute for medical care, diagnosis, or treatment. We recommend that all clients consult with a physician before beginning any new fitness or recovery regimen. You agree to follow all guidance, instructions, and safety protocols provided by Alyesis staff. Alyesis reserves the right to refuse or discontinue services if, in our judgment, your condition poses a risk to your safety or to others, or to require medical clearance before participation.
5. Payments and Refunds
Payment for sessions, packages, or memberships must be made using accepted payment methods before or at the time of booking. Unless otherwise stated in your specific plan, all purchases are non-refundable. In the event Alyesis cancels a session or is unable to deliver a purchased service, you may be entitled to a refund, account credit, or replacement session at our discretion.For recurring memberships, you authorize automatic charges to your selected payment method. You may cancel your membership according to the terms provided at the time of purchase. Late payments or failed transactions may result in suspension of access to Services until your account is brought current.
6. Text Message Consent
By providing your phone number to Alyesis, you expressly consent to receive transactional and informational text messages, including appointment reminders, schedule updates, and service notifications. Marketing or promotional texts will only be sent if you have provided specific opt-in consent. Message frequency may vary based on your activity and preferences.
7. Opt-Out Instructions
You may opt out of receiving marketing text messages at any time by replying STOP to any Alyesis message. After opting out, you may still receive transactional or legally required notifications (for example, receipts or booking confirmations). For help, reply HELP or contact us at info@alyesis.com. Standard message and data rates may apply.
8. Data Use & Privacy
Your contact information is used solely for communication related to Alyesis services and will not be sold or shared with unaffiliated third parties. All data is handled according to our Privacy Policy and applicable laws, including the Telephone Consumer Protection Act (TCPA) and California Consumer Privacy Act (CCPA). Alyesis maintains strict opt-in and opt-out records to comply with carrier and federal messaging regulations.
9. Content and Intellectual Property
All website and service content, including but not limited to text, images, logos, videos, and graphics, is owned or licensed by Alyesis and protected by United States copyright, trademark, and intellectual property laws. You may view and download content solely for personal, non-commercial use. You may not copy, reproduce, distribute, display, or modify any material without prior written authorization from Alyesis.By submitting reviews, feedback, testimonials, images, or any other content (“User Content”), you grant Alyesis a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, and display such content for promotional or operational purposes in connection with the Services.
10. Prohibited Conduct
You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not use the Services to engage in any unlawful, harassing, abusive, defamatory, or fraudulent activity. You must not interfere with the proper functioning of the Services, attempt unauthorized access to systems or networks, tamper with facility equipment, or use another user’s credentials without permission. Any violation may result in immediate termination of your account or denial of access to our facilities and Services.
11. Disclaimers and Limitation of Liability
Alyesis provides all Services on an “as is” and “as available” basis without any warranties, express or implied. We do not guarantee specific fitness, recovery, or therapeutic results, as outcomes may vary by individual. To the fullest extent permitted by California law, Alyesis disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement.To the extent allowed by law, Alyesis’s total liability for any claim arising under these Terms is limited to the total amount you have paid for the Services in the twelve months preceding the event giving rise to the claim. Alyesis shall not be liable for indirect, incidental, special, or consequential damages, including lost profits or data. We are not responsible for failures caused by events beyond our control, such as natural disasters, pandemics, power outages, or internet disruptions.
12. Indemnification
You agree to indemnify and hold harmless Alyesis, its officers, employees, agents, and affiliates from any and all claims, damages, losses, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to your breach of these Terms, your negligence, or your misuse of the Services.
13. Termination and Suspension
Alyesis may suspend or terminate your account or access to Services at any time for violation of these Terms, for non-payment, or for operational or safety reasons. Upon termination, your right to access the Services will immediately cease. Sections concerning indemnification, limitation of liability, and intellectual property rights shall survive termination.

15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, unless both parties agree to alternative dispute resolution. You agree to submit to the personal jurisdiction of such courts.
16. Miscellaneous
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. You may not transfer or assign your rights or obligations under these Terms without Alyesis’s prior written consent. These Terms, together with the Privacy Policy and any other applicable agreements or disclosures, constitute the entire agreement between you and Alyesis with respect to the Services and supersede all prior or contemporaneous understandings.
